Defending Asbestos Claims Against Pennsylvania School Districts
In this presentation, litigators Brian Taylor and Shorav Kaushik will examine the legal framework governing asbestos-related claims brought against Pennsylvania school districts, with a focus on the defenses and immunities available under the Pennsylvania Political Subdivision Tort Claims Act and the Workers’ Compensation Act. Attendees will gain a practical understanding of how sovereign immunity and its exceptions apply to asbestos exposure claims, how the exclusive remedy provision of workers’ compensation shields districts from employee tort suits, and how to strategically coordinate these overlapping bodies of law to mount an effective defense. Attorney Kaushik is a litigator with KingSpry as well as co-chair of the PSBA Facilities and Construction Committee. Taylor is a partner and Chair of the Investigations and Compliance Services Group for KingSpry.
