HuertaThe concepts of renting someone’s summer home or carpooling home during spring break are not novel.  However, technological advances have greatly lowered the transaction costs for both users and suppliers, thereby exponentially increasing ease and use of a sharing-economy business model.

Basically anyone with a smartphone can now arrange their own private driver to take them to their “boutique” home away from home.  While the concepts are not new, the implementation and businesses, or facilitators, of such models are, and with them come legal questions.

Who, if anyone, must collect and remit local TOT (Transient Occupancy Taxes) with an online vacation rental?  Who carries insurance coverage for passengers of a Transportation Network Company?  Who regulates these sharing-economy entities, state or local government, and does the Federal System preempt?
