Plaintiffs’ lawyers are filing an increasing number of complaints that involve a negligent supervision theory as a cause of action.

In the employment discrimination context, the theory of negligent supervision provides another avenue of recovery if the plaintiff can show that the employer is liable for being negligent in controlling working conditions.  By developing practical policies, providing much needed training to managers, and conducting appropriate investigations, HR managers can be a key source of risk management to organizations of all sizes.
