Just yesterday, September 28, 2016, the House of Representatives passed a Bill, by a vote of 246 to 177, to provide for a 6-month delay in the effective date of the Final Rule of the Department of Labor (“DOL”) raising the salary threshold for white collar employees.
Although the delay would be applicable to all employers, the Bill was introduced in the House as regulatory relief for small businesses, schools, and nonprofits, which are the sectors known to be struggling the most with the implementation of the DOL’s salary thresholds.
The Bill, if also approved by the Senate and signed by the President, would extend the effective date of the DOL’s Rule from December 1, 2016 until June 1, 2017.
At this point, having only the approval of the House, a delay in the overtime rule remains merely a possibility. Thus, we recommend that you continue your efforts to implement the proposed Final Rule. You can always reverse fields if need be, but if you stop progress now, with December 1, 2016, fast approaching, it may be more difficult to implement the Final Rule at the last minute.
